PARTICIPANT AGREEMENT, ASSUMPTION OF RISK & LIABILITY RELEASE

Effective for retreats: December 27, 2026 - January 1, 2027 and January 2 - 7, 2027

Organizer: Shuffle House, a Florida Limited Liability Company

Venue Operator: Dora Experience LLC (and affiliated entities: Concepto Cinco Elementos SA de CV, Paledora SA de CV)

Location: Chemuyil, Quintana Roo, Mexico

1. PARTIES AND SCOPE

This Agreement is entered into between the participant ("Participant") and Shuffle House, Florida LLC ("Organizer"). By checking the agreement box during booking, Participant acknowledges having read, understood, and agreed to all terms herein.

This Agreement covers all activities, accommodations, meals, transportation coordination, and events associated with the Shuffle Retreat.

The Organizer acts solely as coordinator and event host. The venue is operated independently by Dora Experience LLC and its affiliated entities. The Organizer makes no representations regarding the venue, its facilities, or its staff beyond what is expressly stated in retreat materials.

2. ASSUMPTION OF RISK

Participation in the Shuffle Retreat involves inherent risks including but not limited to:

  • Physical exertion: dance workshops, yoga, and freestyle movement sessions
  • Extreme heat and humidity (average ~28C / 82F, midday peak ~32C / 90F)
  • Remote jungle location approximately 20 minutes from Tulum; nearest medical care may be 60+ minutes away
  • Exposure to wildlife, insects, uneven terrain, and jungle conditions
  • Water activities: access to and use of private cenote and pool
  • Ground transportation to and from airports and off-site locations
  • Food and beverage consumption, including potential allergen exposure
  • Interactions with other participants, venue staff, and third parties
  • Power outages, weather events, or force majeure conditions

Participant acknowledges that no medical staff is on-site. Basic first aid is available on the property. Participant represents that they are in sufficient physical health to participate in all retreat activities and accepts all risks associated with participation.

3. ACTIVITY-SPECIFIC WAIVERS

Exhibit A - Ocean, Beach & Water Activities

Participant assumes all risks associated with use of the cenote, pool, and any water-adjacent areas. No lifeguards are on duty. Participant agrees not to swim alone and to use all available safety precautions.

Exhibit B - Excursions

Any off-site excursions, whether arranged by the Organizer or independently by the Participant, are undertaken at the Participant's sole risk. The Organizer is not responsible for third-party providers.

Exhibit C - Ground Transportation

Transportation to and from the venue is the Participant's responsibility. The Organizer may facilitate connections with local drivers but does not employ, endorse, or assume liability for any transportation provider.

Exhibit D - Dance Activities

Shuffle dance involves dynamic footwork, jumping, and sustained physical exertion. Participant assumes all risk of physical injury, including muscle strain, falls, and overexertion.

4. LIABILITY RELEASE AND INDEMNIFICATION

To the fullest extent permitted by law, Participant hereby releases, waives, and forever discharges Shuffle House LLC, its members, managers, employees, agents, instructors, and representatives (collectively, "Released Parties") from any and all claims, demands, losses, liabilities, damages, and causes of action arising out of or related to Participant's attendance at and participation in the Shuffle Retreat, whether caused by negligence of the Released Parties or otherwise.

Participant agrees to indemnify and hold harmless the Released Parties from any claims, losses, damages, or costs (including reasonable attorneys' fees) arising from Participant's actions, omissions, or breach of this Agreement.

Participant acknowledges that Shuffle House is not responsible for any damage to or loss of personal property during the retreat.

5. MINOR PARTICIPANTS

Participants under 18 years of age must be accompanied by a parent or legal guardian at all times. The Organizer strongly discourages participation by minors given the inherent physical demands, remote location, and jungle environment. A parent or guardian must execute this Agreement on behalf of any minor participant and assumes full responsibility for the minor's safety and conduct.

6. CONDUCT AND ALCOHOL POLICY

Alcohol is not provided on-site. Participants may bring their own alcohol for personal consumption off-site or in private accommodations. Public intoxication or behavior that endangers other participants or staff is grounds for immediate removal without refund. Participants remain solely responsible for their own conduct and their interactions with other participants.

7. PROPERTY DAMAGE

Participants are liable for any damage they cause to the venue, accommodations, or property of other participants. For damage to common areas, liability may be allocated jointly among participants present or responsible.

8. PHOTOGRAPHY AND MEDIA

The Organizer may capture photos and video during the retreat. Participants who do not wish to be photographed should notify the Organizer at check-in. By not opting out, Participant grants the Organizer a perpetual, royalty-free license to use images and video in which they appear for marketing and promotional purposes.

9. TRAVEL AND MEDICAL INSURANCE

Both travel and/or international medical insurance is encouraged. See the Insurance agreement for encouraged coverage and proof deadlines.

10. FORCE MAJEURE

The Organizer shall not be liable for cancellation, delay, or modification of the retreat due to circumstances beyond its reasonable control, including but not limited to natural disasters, government travel restrictions, pandemic declarations, acts of war, civil unrest, public safety emergencies, or venue closure. Remedies in such cases are governed by the Cancellation Policy.

11. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the State of Florida. Any dispute arising from or related to this Agreement or the retreat shall be resolved by binding arbitration in Palm Beach County, Florida, under the Consumer Arbitration Rules of the American Arbitration Association. Participant waives any right to participate in a class action lawsuit or class-wide arbitration.

12. ELECTRONIC SIGNATURE

Participant acknowledges that checking the agreement checkbox during the online booking process constitutes a valid electronic signature and has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable Florida law.

13. SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
